Rental Agreement

This Rental Agreement (the “Agreement”) is entered into between Car Rentals Phuket (the “Company”) and the undersigned customer (“Customer”) as of the details provided via the website, phone or email. The Company and the Customer hereby agree as follows:

Definitions

For the purposes of this Agreement:

  1. “Rental Period” refers to the start and end dates and times specified in this Agreement during which the Customer will rent the Car.
  2. “Security Deposit” refers to the amount paid by the Customer to cover potential damages or additional fees.
  3. “Car” refers to the car specified in this Agreement.

Rental Terms

  1. The Company agrees to rent the Car to the Customer for the Rental Period specified herein.
  2. The Customer agrees to pay the Company the rental fees specified in this Agreement for the Car.
  3. A minimum of 20% of the order total, including the security deposit, is required to secure the booking.
  4. The Customer agrees to return the Car to the Company in the same condition as when rented, except for normal wear and tear, at the end of the Rental Period.
  5. Free delivery is offered to customers that book for 3 or more days and are located within a 7km distance of our Pasak office location.
    Delivery surcharges apply for all other locations as follows:
    – 7 to 13.5 km away: 300 THB each way.
    – 13.6 to 25 km away: 400 THB each way.
    – 25.1 km away and above: 500 THB each way.
  6. The customer agrees to not drive the vehicle outside of Phuket as this would void the insurance policy. A 3,000 THB penalty applies if the customer fails to comply.
  7. Where the order is not eligible for free delivery, the customer will pay any additional delivery charges on delivery of the car.

Late Return

If the Car is not returned by the end of the Rental Period, the Customer will be charged a pro-rata daily rate for an additional day as a minimum.

Late Payments

  1. All bookings and extensions must be paid in advance and cannot be deducted from the security deposit.
  2. Late payments will incur in a late fee. This is calculated at 10% of the booking fee or 50 THB per day (whichever one is higher)

Maintenance and Repairs

  1. The Company will ensure that the Car is in good working order at the commencement of the Rental Period.
  2. The Company is responsible for all maintenance and repairs resulting from normal wear and tear. The Customer shall not undertake any repairs or maintenance unless authorised by the Company in writing.

Insurance

  1. Third-party liability insurance is included in the rental fee by default. This insurance covers damages to third parties resulting from an accident caused by the Customer.
  2. The Customer acknowledges and agrees that they are responsible for checking their travel insurance or any other insurance policy to ensure that they are covered in case of an accident involving the Car.
  3. The Company may, from time to time, offer optional additional insurance options for the Customer. These options, if available, will be presented to the Customer at the time of rental and may require an additional fee.

Customer Responsibilities

  1. The Customer is responsible for operating the Car safely and in compliance with all applicable laws, regulations, and traffic rules.
  2. The Customer is responsible for any fines, penalties, or damages incurred while operating the Car, including but not limited to traffic fines, parking fees, or damages caused by an accident.
  3. The Customer must report any accidents, damages, or theft of the Car to the Company and the appropriate authorities immediately.
  4. The car(s) will be handed over with a full tank of petrol. It is the customer’s responsibility to refuel the car(s) fully before return. A 50 Baht Refuel Fee + Gas Costs will be deducted from the security deposit in the event that the car has not been refuelled.
  5. The car(s) must be returned reasonably clean, otherwise, a 150 THB cleaning fee will apply.
  6. The customer is responsible for all costs associated with any damage to the tires. This includes, but is not limited to, accidental punctures, tears, and cuts. For minor damages such as small punctures, we will patch the tire. For more significant damages, tire replacement will be necessary.
  7. The cost of tire patching will be deducted from the security deposit at a rate of 200 THB per tire. The cost for tire replacements will be determined upon the car’s return/collection.
  8. Any lost or damaged electronic car keys will need to be replaced at the customer’s expense. The replacement cost for an electronic key ranges from 4,000 to 6,000 THB, depending on the model.

Cancellation Policy

  1. Cancellation by the Customer 48 hours before the start of the Rental Period is free of charge.
  2. Stripe and other processing fees are non-refundable if the cancellation is made at the customer’s request, regardless of timing.
  3. Cancellation by the Customer within 24 hours before the start of the Rental Period incurs a 10% charge of the rental fee.
  4. Cancellation by the Customer within 12 hours before the start of the Rental Period incurs a 20% charge of the rental fee.

Security Deposit

The Security Deposit will be returned in full to the Customer upon return/collection of the Car and any other accessories provided at the time of rental.

Data Protection

The Company will process and store the Customer’s personal data in accordance with applicable data protection laws and the Company’s privacy policy, available at Car Rentals Phuket Privacy Policy.

Indemnification

The Customer agrees to indemnify, defend, and hold harmless the Company, its officers, employees, and agents from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or in connection with the Customer

Limitation of Liability

To the maximum extent permitted by law, the Company’s liability is limited to the rental fee paid by the Customer. The Company shall not be liable for any indirect, special, consequential, or punitive damages.

Termination

The Company reserves the right to terminate this Agreement and repossess the Car without notice in the event of a breach of any term or condition herein.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Thailand.

Entire Agreement

This Agreement constitutes the entire understanding and agreement between the Company and the Customer with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements, representations, and understandings, whether written or oral.

By paying the booking fee or completing the booking via the website, the Customer acknowledges that they have read, understood, and agree to the terms and conditions set forth in this Agreement.
